The astraltwin.com site (“the Site”) provides each User with access to a number of services available at the time of connection.

The Site also provides access to a range of paid services allowing the User, if desired, differentiated access to Information.

The purpose of these Terms of Service is to set the rules for the use of the Site by the User as well as the obligations of ASTRALTWIN.

Thus, the User undertakes, during each of his visits to the Site, to comply with these Terms of Service which apply to all the services available on the Site, whether these are provided free of charge or purchased.

Consequently, the User accepts, fully and without any reservation, all of these Terms of Service of the Site before any subscription, consultation of Information and/or simple free use of the Site. In case of taking out a subscription on the Site, acceptance of the Terms of Service occurs when the Subscriber, after having completed the Online Registration Form, clicks on the validation button appearing on the summary page of his order.

In case of consultation of Paid Information on the Site, acceptance of the Terms of Service occurs when the User clicks on the validation button. More generally, the User accepts all the Terms of Service of the Site by the sole fact of his access to the Site. Certain services of the Site may require additional and specific Terms of Service. These special additional Terms of Service supplement these general Terms of Service.

I. DEFINITIONS

In these Terms of Service, words or expressions starting with a capital letter will have the following meaning:

User means any natural or legal person having access to the Site, in a professional capacity, regardless of their location and the terms of their connection to the Site. The User can therefore be a Subscriber, a Registered User, an Authorized Person, or more generally a simple Internet user.

Registered User means a natural or legal person, French or foreign, who has registered to access free and/or paid services on the Site.

Subscriber means a Registered User who has subscribed to one of the subscription plans offered by ASTRALTWIN.

Deed of Purchase means any transaction, other than subscription, requiring a means of payment.

Acknowledgment of receipt means the e-mail sent to the Subscriber or to the User Registered by ASTRALTWIN summarizing the essential elements of his subscription contract or of his Profile and, to do so, including some of the elements of the Registration Form.

Access codes means the identifier of the Subscriber, Registered User or Authorized Person and his connection password provided to ASTRALTWIN during his registration, allowing him to identify himself and connect to the various subscribed services provided on the Site.

Account means the space made available to the Subscriber or Registered User on the Site, allowing him to access, after identifying himself by his Access Codes, all the data concerning his contract, to its possible invoices and its Profile.

Cookie is a small piece of information that a website can send to a personal computer’s hard drive and then track it down. Certain personalized services of the Site use temporary cookies for their proper functioning and require the acceptance by the User of these cookies. If the User’s personal computer browser is configured to refuse them, access to these services may be impaired or even impossible. ASTRALTWIN designates the company identified at the beginning of these Terms of Service.

Profile means the information communicated by the User when registering or during a connection, namely the personal data of the Subscriber or the Registered User necessary for the management of his subscription or his access to the Site and the payment method chosen for the services thus selected.

Authorized Person means any natural person, employee or collaborator of the Subscriber or Registered User, duly authorized and able to connect to the paid services of the Site by the attribution by ASTRALTWIN of an Access Code, under the conditions described below, under the authority and responsibility of the Subscriber or Registered User.

Site refers to all the products and services offered by ASTRALTWIN on the Internet.

Paid Information Tariff means the price for viewing and using the Paid Information on the Site, including Pay-As-You-Go, in effect on the date of signature. If the www.astraltwin.com site is stopped, no refund will be possible.

Holder means any natural or legal person holding economic and/or moral rights to the Information.

II. SUBJECT MATTER

ASTRALTWIN grants the User a revocable, non-transferable, non-exclusive, free or paid license for personal use of the Site depending on the Information consulted on the Site.

III. ACCESS AND USE OF INFORMATION AVAILABLE ON THE SITE

III.1. The equipment (computers, telephone, software, telecommunication means, etc.) allowing access to the Site and some of its specific services are the sole responsibility of the User, as are the telecommunications costs incurred by their use.

III.2. When registering online, the User undertakes to provide true, exact and complete information as requested in the Registration Form and therefore to keep it up to date without delay. In the event that the User provides false, inaccurate, outdated or incomplete information, ASTRALTWIN is entitled to suspend or terminate, under the conditions referred to in Article V of these Terms of Service, his subscription and refuse him, immediately and for the future, access to all or part of the Site.

III.3. Minors are allowed to register and/or subscribe on the Site, on condition that they have previously obtained from the holder(s) of parental authority concerning them, the authorization to do so and that the holder(s) of parental authority has (have) agreed to be the guarantor(s) of compliance by the minor user with the Terms of Service. Any use of the services and/or subscriptions available on the Site by a minor user is carried out under the full responsibility of the holder(s) of parental authority over the minor user concerned.

III.4. ASTRALTWIN grants the User a right of consultation, use and access to Information under the following conditions:

In general, and without this list being considered exhaustive, the User agrees to:

  • never communicate your Access Codes,
  • download the Information on your equipment only for personal, non-commercial and time-limited use; print the Information downloaded on paper only on the condition that the copies thus constituted are for exclusively personal use, which excludes in particular any reproduction for professional or commercial purposes or for mass distribution, free or paying;
  • not keep the downloaded Information for more than forty-eight (48) hours and destroy it after this period;
  • not to copy all or part of the Site onto another site or an internal company network;
  • not to produce a press review or panorama based on information or photographs marked as belonging to a third party service provider, nor to reuse this information to offer it on any medium whatsoever outside the strict legal framework of private copying;
  • not to extract or reuse, including for private purposes, without the prior written authorization of ASTRALTWIN, a substantial part or not of the content of the databases and archives constituted by the Site;
  • to set up appropriate control systems according to technical developments to avoid any “hacking” of Information and in particular to prevent unlawful use or use contrary to these Terms of Service of any Information in any way and in any form whether it be ;
  • to inform ASTRALTWIN as soon as it becomes aware of a “hacking” and in particular of any illegal or non-contractual use of the Information, regardless of the distribution method used.

Violation of these mandatory provisions subjects the User and all persons who participated in them to the criminal and civil penalties provided for by law.

IV. USE OF PERSONAL DATA AND RESPECT FOR PRIVACY

IV.1. Access Codes allow the User to identify himself and connect to the subscribed services of the Site. These Access Codes are personal and confidential. They can be modified online by the User (only the password) or by ASTRALTWIN (the username and/or password).
The User is entirely responsible for the use of the Access Codes concerning him. Any connection to the Site or transmission of data made using the User’s access codes will be deemed to have been made by the latter.

IV.2. The User agrees to keep his Access Codes secret and refrains from disclosing them in any form whatsoever to third parties.

In this regard, the User has the possibility to ensure that at the end of each session, he can disconnect explicitly. In the event of loss, theft or accidental disclosure of their Access Codes, the User must immediately inform Customer Service, by email or post, which will then cancel the Codes as soon as possible. The User will receive a new password.
Any loss, theft, misappropriation or unauthorized use of Access Codes and their consequences are the responsibility of the User.

IV.3. Opening a new session using Access Codes already in use will automatically close the 1st open session.

IV.4. ASTRALTWIN respects the privacy of Users and strictly complies with the laws in force on the protection of privacy and individual freedoms. Thus, the personal data transmitted by each User is intended exclusively for the services of ASTRALTWIN. They are in no case transmitted to third parties for advertising and promotion purposes without their prior consent.

In application of the provisions of law n ° 78-17 of January 6, 1978, modified by law n ° 2004-801 of August 7, 2004, relating to data processing, files and freedoms, each User has a right opposition, access, rectification and deletion of data concerning him. Each User can exercise this right online at any time by going to his Account on the Site or by writing to Customer Service, by e-mail using the Site contact page.

In addition, ASTRALTWIN guarantees that any processing of personal data is also subject to law n ° 78-17 of January 6, 1978, amended by law n ° 2004-801 of August 7, 2004, relating to data processing, files and to freedoms.

V. EFFECTIVE DATE – DURATION – TERMINATION

V. A. IN THE CASE OF A SUBSCRIPTION

V.A.1. The commissioning of a subscription is carried out by ASTRALTWIN as soon as possible, in particular taking into account technical requirements. The commissioning of an electronic subscription is carried out by ASTRALTWIN upon receipt by e-mail by the Subscriber, and where applicable by the Authorized Persons, of their Access Codes regardless of the subscription method and payment, except special conditions mentioned on the subscription offer. The activation of a paper subscription takes effect upon receipt of the first number served.

V.A.2. The subscription is taken out for an indefinite period, subject to the application of the provisions of Articles V.C. and VI.6.2.3.1. below, fixed-term subscriptions cannot be terminated by the Subscriber or ASTRALTWIN before their expiry.

V.A.3. ASTRALTWIN will not be held responsible for non-performance or delay in performance of an obligation contained in Terms of Service, in the Terms of Sale and/or in the subscription contract, following the occurrence of a case of force majeure, as recognized by the jurisprudence of French courts.

The case of force majeure suspends the obligations arising from these Terms of Service, the Terms of Sale and/or the subscription contract for its entire duration.

V.A.4. The end of the term or the termination of the subscription contract results in the removal of the Subscriber’s access to his subscription. However, the Subscriber retains his Profile data as a Registered User.

V. B. IN THE CASE OF A DEED OF PURCHASE

V.B.1. The commissioning of a Deed of Purchase is carried out by ASTRALTWIN upon validation of the payment by the Bank, a payment institution or by an internet access provider.

V.B.2. The Deed of Purchase is made for a fixed period.

V.B.3. The Registered User loses his rights to his Deed of Purchase as soon as the validity date mentioned on the purchase page has passed, whether or not he has used his purchase partially or not.

V. C. TERMINATION

ASTRALTWIN reserves the right to suspend and/or terminate automatically, without compensation, and without legal formalities, any subscription, consultation of Paid Information or other service in the event of a serious breach by the Subscriber or Registered User to these Terms of Service, without prejudice to the right for ASTRALTWIN to take legal action for the payment of any damage and interest in compensation for its entire prejudice.

VI. PRICES AND TERMS OF PAYMENT

VI.1. Prices

The price of subscriptions is that in force on the day of their subscription. Any modification of the Subscription Tariff is therefore of no consequence on the current subscription.
The Tariff for Paid Information is that in effect on the day of its request by the User.

Price reductions may be granted depending on the quantity of subscription taken out by the same Subscriber.

VII. RULES FOR USE OF THE INTERNET

ASTRALTWIN undertakes to make its best efforts to secure access, consultation and use of Information in accordance with the rules of Internet usage.

The Site is accessible 24 hours a day, 7 days a week except in the event of force majeure or the occurrence of an event beyond the control of ASTRALTWIN and subject to any breakdowns and maintenance interventions necessary for the proper functioning of the Site.
Maintenance interventions may be carried out without the Users having been previously notified.

The User declares to accept the characteristics and limits of the Internet, and in particular to recognize that:

  • its use of the Site is at its own risk; the Site is accessible to him “as is” and according to its availability;
  • any material downloaded by the User or obtained in any other way while using the Site, is at his own risk; the User is solely responsible for any damage suffered by his computer or any loss of data resulting from the downloading of this material or from the consultation of the Site;
  • it is therefore up to him to take all appropriate measures to protect his own data and / or software from contamination by any viruses circulating through the Site and/or the Information;
  • no advice or information, whether oral or written, obtained by the User from ASTRALTWIN or during use of the Site is liable to create any guarantees not expressly provided for in these Terms of Service; The User is solely responsible for the use he makes of the Information on the Site and, consequently, ASTRALTWIN cannot be held responsible for direct or indirect damage resulting from the use of this Information;
  • he is solely responsible for the use of the content of sites having a hypertext link to the Site, ASTRALTWIN declines all responsibility for such content;
  • he is aware of the nature of the Internet, in particular its technical performance and response times for consulting, querying or transferring Information;
  • the communication of its Access Codes or in general of any information deemed confidential is made under its own responsibility;
  • it is his responsibility to take all necessary measures to ensure that the technical characteristics of his equipment allow them to consult the Information;

VIII. INTELLECTUAL PROPERTY OF ASTRALTWIN

VIII.1. ASTRALTWIN is the exclusive owner of all intellectual property rights relating to both the structure and the content of the Site.

VIII.2. These Terms of Service do not involve the transfer of any intellectual property rights for the benefit of the User, either on the structure or on the content of the Site.

Thus, the User undertakes in particular not to use the Information in such a way as to infringe the rights of ASTRALTWIN and that such use does not constitute an infringement or unfair or parasitic competition of the Information.

IX. LIMITATION OF LIABILITY

ASTRALTWIN cannot give any guarantee of reliability with regard to all the Information and other data present on the Site, whether provided by ASTRALTWIN, by its partners or by any third party.
Accordingly, all Information and other data appearing on the Site is provided for informational purposes only.
The provision of Information cannot be assimilated, in any way whatsoever, to specific advice or decision support in order to carry out a transaction or make an investment decision. The User therefore acknowledges that he uses the Information and other data from the Site that is offered to him at his own risk.

As a result, ASTRALTWIN cannot be held responsible for any prejudice or damage that may result from the use of the Information and other data available on the Site.
Likewise, ASTRALTWIN declines all responsibility with regard to the content, operation, services offered and access to websites published by third parties and accessible from the Site by hypertext links.
Finally, if the User contracts with advertisers on the Site, ASTRALTWIN assumes no obligation or responsibility for the delivery of products and services offered by its business partners.
